Vendor warrants, for a period of (12) months from the “Warranty Start Date” (defined as the date Ditch Assist is purchased from the Vendor or an Authorized Dealer of the Vendor), that hardware purchased shall be free from defects in material and workmanship under normal authorized use consistent with the intended use and installation of the product. The Vendor will repair or replace, at no charge, any hardware component of the system that fails during normal service within the 12-month warranty period from the “Warranty Start Date”. Vendor makes no other warranties express or implied. The sole remedy for breach of this express warranty is the repair or replacement of the product as described below. VENDOR SPECIFICALLY DISCLAIMS THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
Warranty is not provided for damage resulting from abuse, modification, neglect, accidents, vandalism, acts of nature, improper installation, improper storage, or any cause that is outside the normal, intended use and installation of the system.
Vendor reserves the right to repair products that fail during the warranty period. Specifically, in the case where a product failure is reported after the product has been installed and used successfully for its intended purpose for any period of time. Vendor may require that products that fail during the warranty period be returned to Vendor for evaluation. Repaired, rebuilt, or replaced products will be warranted for the remainder of the original product warranty. Vendor will maintain as its property, all original product, or product components, replaced as a result of product repair, rebuild, or replacement.
All software and firmware manufactured and/or provided by the Vendor is sub-licensed on an “as is” basis. Vendor shall not be liable for direct, indirect, incidental, or consequential damages, including loss of data, resulting from the use of Vendor-supplied software and firmware.
